About these terms

These terms are an agreement between you and [Company name], [registered address], Poland (“Pocketwire”, “we”) about the Pocketwire website, dashboard, Android app, desktop Bridge and MCP server (together, the “Service”). By creating an account or using the Service, you accept them.

If you use Pocketwire for a company or other organization, you accept these terms on its behalf and confirm that you’re allowed to.

What Pocketwire does

Pocketwire lets AI apps that you connect ask to send text messages from your own phone number, through a phone or computer that you pair. Your device sends the messages, over your own mobile plan, following your approval settings.

We relay requests between your AI apps and your devices. We aren’t a mobile carrier and don’t provide phone numbers. Whether a message arrives depends on your device, your carrier and the recipient’s network, so we can’t promise delivery.

Your account

  • You must be 18 or older.
  • Give a working email address and keep your password to yourself.
  • You’re responsible for what happens in your account, including what the AI apps you connect do with the access you granted them.
  • If you think someone else is using your account or your devices, pause sending and tell us at security@pocketwire.app.

Your phone and your mobile plan

Texts go out from your SIM and count against your mobile plan. Your carrier’s charges, limits and terms apply, including for international numbers. Pocketwire never charges per text.

AI apps and approvals

You choose which AI apps to connect and which approval settings to use. AI agents can misunderstand a request or be manipulated by content they read, so when your phone or dashboard asks, check the recipient and the text before you tap Send.

Messages sent from your account are your messages, including those sent without asking because of your settings, for example to trusted contacts.

Acceptable use

Don’t use Pocketwire to:

  • send spam, or bulk or unsolicited messages, including marketing to people who haven’t agreed to receive it;
  • run campaigns, mass notifications or an SMS gateway for other people;
  • text premium-rate numbers or short codes to make money, or abuse carrier billing in any other way;
  • harass, threaten, deceive or defraud anyone, impersonate someone else, or send phishing or malware;
  • break the law where you or the people you text are, including rules on electronic marketing, consent and data protection;
  • get around limits, approvals or security measures, overload or probe the Service, or access accounts or devices that aren’t yours;
  • resell or share access to the Service without our written agreement.

Limits on messages and new numbers are part of the Service. We may refuse requests that look like abuse.

Plans and payment

The Free plan and the paid plans, with their prices and limits, are described on our pricing page. Prices are in US dollars, [plus applicable taxes].

Paid plans are paid in advance, monthly or yearly, through [payment processor, to be decided], and renew automatically until you cancel. When you cancel, you keep the plan until the end of the period you paid for. [Refunds: to be decided.] If you’re a consumer, you keep every right that consumer law gives you.

We may change prices or plan limits with at least 30 days’ notice by email. A new price applies from your next billing period.

Your content

Your messages and other data stay yours. You let us process them only to provide the Service, as described in the privacy policy.

Our software

While your account is active, you may use the Service and our apps for their intended purpose. You may not copy, modify or reverse engineer them, except where the law allows it. Where we publish code under an open-source license, that license applies to that code instead.

Self-hosting

If you run Pocketwire on your own server, you’re responsible for that server, its security, its backups and its legal compliance. Our sections on availability and on the data we hold don’t apply to it. [Terms for commercial self-hosting: to be decided.]

Availability and changes

We work to keep Pocketwire running, but we provide it as it is and as available, without a guarantee of uptime. We may change or remove features. If a change takes away something a paid plan includes, we’ll tell you in advance.

Suspension and ending

You can stop using Pocketwire at any time, and ask us to delete your account at privacy@pocketwire.app.

We may suspend or close your account, with notice where that’s reasonable, if you break these terms, if your use puts the Service, carriers or other people at risk, or if the law requires it.

Liability

Nothing in these terms limits liability that the law doesn’t allow us to limit, or your rights as a consumer.

Otherwise, we aren’t liable for indirect or consequential loss, for messages that your device or carrier didn’t deliver, for messages sent within your own settings, or for your carrier’s charges. Our total liability for any claim is limited to what you paid us in the 12 months before it [or a fixed amount for the Free plan, to be decided].

Changes to these terms

We may update these terms. For important changes, we’ll email you at least 30 days before they apply. If you don’t agree, you can close your account before then.

Law and disputes

Polish law applies, and disputes go to the courts of [city], Poland. If you’re a consumer, you also keep the protection of the mandatory law of the country where you live, and can bring a claim there.
